CAA Gag Clause Attestation
Annual attestation of compliance with the Consolidated Appropriations Act (CAA) that a plan sponsor has not entered into contracts that would restrict the plan or issuer from providing, accessing, or sharing certain information about provider price and quality and de-identified claims.

ACA compliance.
Planstin administers a range of health plans that provide minimum essential coverage (MEC) or minimum value coverage (MVP). This means that you can confidently avoid the costly Employer Shared Responsibility Penalty Part A or B.

What is the employer shared responsibility penalty?
Employers with more than 50 full-time, or full-time equivalent, employees must offer MEC-compliant health plans to full-time employees and their dependents, or face a tax penalty. This Employer Shared Responsibility Penalty (Section 4980H-Part A) is equal to $2,900 (2025) for every full-time employee after the first 30—even if those employees have coverage from another source.
A second type of Employer Shared Responsibility Penalty (Section 4980H-Part B) may apply to employers who offer MEC plans that are not minimum value plans (MVP). This penalty is $362.50 (2025) per month for each full-time employee who receives subsidized coverage through the marketplace. However, this penalty is only assessed per employee who receives tax subsidized insurance (not every full-time employee) and cannot exceed the first penalty.
